The Environmental Agency faces investigations stemming from allegations of a failure in providing UK residents, in particular those in North Yorkshire, with an adequate flood defence.

The River Foss barrier, which afforded York with over 30 years' protection, appears to have been raised, leaving resident home owners and businesses flooded. It is reported that the reason for raising the barrier was due to a risk of an electric failure. The barrier was built in 1987 after serious flooding in 1982 and is designed to stop York's two rivers, the Ouse and Foss, from converging.

Ehsan Kabir, Partner of No.1 Solicitors, issued a formal statement:

"In order to help flood victims over the UK, I have commissioned a legal team to evaluate options for a legal class action suit against the Environmental Agency, on behalf of affected flood victims. All flood victims can register their interest with us and all cases will be taken on a no-win, no-fee basis, allowing access to justice for all. If you have been affected, we want to hear from you.

The key components to our investigation are whether the present flood defence system was adequate, implemented and maintained properly. If not, which evidence strongly indicates, then flood victims, being businesses and home owners, may be entitled to seek redress by way of monetary compensation or an apology, for those are who fortunate to be afforded with flood risk insurance, which I understand is scarcely offered."
