Klövern's tax surcharge quashed by the Administrative Court

The Administrative Court in Stockholm has quashed the tax surcharge of SEK 493 million, previously imposed on Klövern for the tax assessment for 2003. The Tax Agency has until 13 May 2012 to appeal against the Administrative Court's judgment to the Administrative Court of Appeal. The Administrative Court in Stockholm has quashed the tax surcharge of SEK 493 million, previously imposed on Klövern for the tax assessment for 2003. The Tax Agency has until 13 May 2012 to appeal against the Administrative Court's judgment to the Administrative Court of Appeal.

 

The issue of incorrect information in a request for a deduction submitted to the Tax Agency in 2003 has now been settled in a judgment by the Administrative Court. According to the Administrative Court, Klövern has objectively submitted incorrect information. However, the court considers that it is manifestly unreasonable for the tax surcharge to be imposed.

 

Klövern has since the Tax Agency's decision had a respite with payment of the tax surcharge, which has therefore not been charged to Klövern's statement of income or balance sheet. The judgment of the Administrative Court means that the Tax Agency's decision is nullified.
