CYBERPOL Public Advisory Notice

Public Advisory Notice and Persons of Interest – Cyber Inquiry #2025/144

Royal Decree Approved and Issued under the authority of the Ministry of Justice, CYBERPOL Pursuant to Royal Decree WL 22/16.595 (approved 2 July 2015) whereas CYBERPOL operates as a federally ratified institution endowed with comprehensive operational jurisdiction and enforcement prerogatives under the rule of law issues the following Public Advisory Notice and Persons of Interest – Cyber Inquiry #2025/144 notice.

Legal Basis for Issuance

In accordance with the powers conferred by Royal Decree WL 22/16.595, duly approved by the Minister of Justice on 2 July 2015, CYBERPOL – the International Cybercrime Police Organization, hereby issues this Public Advisory Notice in relation to an ongoing cyber inquiry into alleged unlawful online activities.

This inquiry concerns targeted disinformation campaigns, potential online defamation, and related violations of applicable international cyber law, European Union directives, and national penal provisions.

International and Regional Legal Framework

The following international and EU legislative instruments provide the applicable framework for this inquiry:

Directive 2000/31/EC (E-Commerce Directive), Article 14 – Establishes hosting provider liability, requiring service providers to remove or disable access to unlawful information upon obtaining actual knowledge.

Regulation (EU) 2022/2065 (Digital Services Act, DSA) – Enhances obligations for intermediary service providers regarding illegal content, transparency, and accountability.

Directive (EU) 2015/2436 – Relating to harmonization of the laws of Member States concerning trademarks, also extending protection against misuse in digital environments.

Regulation (EU) 2017/1001 (European Union Trade Mark Regulation, EUTMR), Article 9 – Prohibits unauthorized use of protected trademarks in digital or online environments.

EU Charter of Fundamental Rights, Article 7 – Grants the right to respect for private and family life, including protections of reputation against defamation and unlawful online targeting.

Relevant National Penal Code Provisions – In numerous jurisdictions, defamation (including digital defamation) is codified as either a criminal offense or civil wrong, depending on applicable domestic law.

Persons of Interest and Voluntary Questioning

As part of the ongoing inquiry for Cyber Inquiry #2025/144, CYBERPOL has identified persons of interest associated with the publication, distribution, or hosting of digital media alleged to:

Disseminate false or defamatory information against international institutions and/or their staff,

Constitute online threats, harassment, or intimidation,

Infringe legal protections under the E-Commerce Directive, Digital Services Act, and related laws.

All such individuals are hereby formally invited to voluntarily present themselves for questioning through their legal counsel or other designated communication channels provided by CYBERPOL.

This listing does not constitute an allegation of guilt, formal charge, or finding of liability. Each individual remains entitled to the presumption of innocence until and unless proven otherwise by a competent court of law.
